West Michigan school chief warns staff of severe cuts, says Gov. Rick Snyder's budget aims to break teacher union

Mackinaw Center Lawsuit Dismissed

Earlier today, Judge James Redford of the Kent County Circuit Court dismissed a lawsuit filed by the Mackinac Center against numerous school boards and local associations in Kent County. In December, the Mackinac Center filed a lawsuit on behalf of five taxpayers from Kent County and trumpeted its action in news releases, radio interviews, and on the Mackinac Center website. The lawsuit challenged a collaborative agreement reached among numerous Kent County school boards and local associations that included a provision against privatization of educational support professionals during the term of the agreement. To the credit of the Kent County school districts involved, they coordinated the defense of the lawsuit with us and continued to support the legality of the no-privatization clause of the collaborative agreement. Both the school districts and the associations filed motions to dismiss the case, which were heard before Judge Redford on Friday, February 18. In today's decision, the court agreed with each of the positions asserted by the school districts and associations and dismissed the case for lack of standing, lack of subject matter jurisdiction, and filing beyond the applicable statute of limitations.It is doubtful that we have heard the last on this legal challenge, as the Mackinac Center may well appeal to the Michigan Court of Appeals. However, in the meantime, it is great to have some good news that benefits our members.
